ADOPTED ORDINANCE NO. 18-001

SUMMARY

NOTICE is hereby given that at its regularly scheduled meeting on January 9, 2018, the Fresno County Board of Supervisors adopted Ordinance No. 18-001, an Ordinance of the County of Fresno, State of California. 

SUMMARY OF ORDINANCE

The purpose of the ordinance is to reorganize and update those Chapters of Title 8 that address or govern the management, collection or disposal of solid waste.  As part of the reorganization of Title 8, current Chapter 8.24 shall be renumbered as Chapter 8.19. Chapter 8.20 shall be amended by deleting outdated provisions and revising selected provisions to enhance clarity and ensure consistency with current law and with those other Chapters of Title 8 applicable to solid waste management.  Chapter 8.23 shall be added to provide for the establishment and implementation of a Reporting System for Recycling Haulers (RSRH), requiring any person or entity engaged in commercial hauling of recyclable materials to register with the County and to submit, on a quarterly basis, information on the volume and types of such materials they collect within the County’s unincorporated area.  Violations of the requirements of Chapter 8.23 shall be subject to enforcement as an infraction with potential imposition of administrative citations or fines.  Chapter 8.24 shall be added to establish a Non-Exclusive Waste Hauler Agreement (NEWHA) Program, applicable with respect to all haulers who engage in transactions within the County involving the collection, for compensation, of solid waste amounting to ten (10) cubic yards or more.  Such transactions are not governed by the provisions of Chapter 8.21, which in 2005 established the Exclusive Service Area Program that will continue to regulate residential and commercial collection within the unincorporated area of solid waste amounting to less than ten (10) cubic yards.  Chapter 8.24 shall provide additional regulation and oversight, and haulers engaged in providing services under the NEWHA Program will be required to obtain the requisite permit, and to execute and comply with the provisions of the Non-Exclusive Waste Hauler Agreement.

CITY OF CLOVIS SUMMARY OF AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLOVIS AMENDING SECTION 9.58.040 AND ADDING SECTION 9.58.070, OF CHAPTER 9.58, OF TITLE 9, OF THE CLOVIS MUNICIPAL CODE PERTAINING TO HOME OCCUPATION PERMITS

On January 8, 2018, at 6:00 p.m., in the Council Chamber, 1033 Fifth Street, Clovis, CA, 93612, the Clovis City Council adopted an ordinance amending Section 9.58.040 and adding Section 9.58.070, of Chapter 9.58, of Title 9, of the Clovis Municipal Code pertaining to home occupation permits.  Over the past year, the City of Clovis has begun to receive complaints regarding short term vacation rentals.  There is currently nothing in the municipal code regulating short term vacation rentals.  Short term rental generally means the rental of a dwelling by the owner to another person for a period of less than thirty (30) consecutive days. This does not include city-approved hotels, motels, bed and breakfasts, and time-share projects.  This ordinance amendment would require a home occupation permit for operation of short term vacation rentals and implement operating regulations and standards.

FRESNO IRRIGATION DISTRICT

NOTICE OF INTENT TO ADOPT A MITIGATED NEGATIVE DECLARATION

FOR THE CENTRAL BASIN RECHARGE PROJECT

NOTICE IS HEREBY GIVEN that the Fresno Irrigation District (FID) plans to adopt a mitigated negative declaration for the Central Basin Recharge Project. The public hearing will be held by the District’s Board of Directors on February 20, 2018 at 4:00pm, at the District Office, 2907 South Maple Avenue, Fresno, CA 93725.

The Central Basin Project consists of approximately 90-acres of groundwater recharge/regulation facilities at three different site locations.  Basin #1 facility of approximately 35.74 acres is proposed at the SW corner of Hughes and Central avenues, across APN’s 328-021-10S and 328-021-01S, Basin #2 facility of approximately 40 acres is proposed at the SE corner of East & Malaga on APN 330-160-01, and Basin #3 facility of approximately 14.25 acres is proposed at the NE corner of Orange & Lincoln, on APN 334-320-41. The basins will be up to 15 feet deep and no greater than six feet in external height. The Proposed Project is located in western Fresno County, near the community of Easton.

Pursuant to the California Environmental Quality Act (CEQA), an Initial Study/Mitigated Negative Declaration has been prepared, describing the degree of potential environmental impacts of the proposed project. The District has assessed the potential environmental impacts of this proposed project and has determined that they will be less than significant with mitigation. Copies of the Initial Study and proposed Mitigated Negative Declaration are on file and available for public review at the Fresno Irrigation District office located at 2907 South Maple Avenue, Fresno, CA 93725. The public review period during which the District will receive comments on the proposed Mitigated Negative Declaration will begin on January 17, 2018 and end on  February 15, 2018.  Comments should be in writing, if possible, and addressed to Briza Sholars at Provost & Pritchard, 286 West Cromwell Avenue, Fresno, CA 93711, or at bsholars@ppeng.com

City of Clovis Announces a Public Workshop 

Enterprise Canal Class l Trail/Pedestrian Bridge 

Master Plan

The City of Clovis in partnership with Caltrans District 6 has developed a Master Transportation Plan of the proposed Class I trail/pedestrian bridge project to be located along the Enterprise Canal near State Route 168.

The City is interested in hearing from residents, business owners, special interest groups, and any other parties on the draft plan. The proposed project is intended to focus on the need, feasibility, and future development of a Class I trail/pedestrian bridge along the Enterprise Canal, extending south of Owens Mountain Parkway, and over State Route 168, which will serve to link the commercial, residential, Clovis Community Medical Center Complex, and business campuses in the immediate area. Three alternative alignments are currently proposed for this bicycle/pedestrian bridge structure, and will be the focus of review at the workshop.

Once constructed the bridge will provide bicyclists and pedestrians safe, direct, and continuous access over State Route 168, providing connectivity to Clovis’ extensive trail network in the community, serving to encourage citizens to move around the city on foot and bike.

Community members are encouraged to attend this public workshop on January 24, 2018 from 5:30 p.m. to 7:30 p.m. at the Miss Winkles Pet Adoption Center located at 85 N Temperance Ave, Clovis, 93611, to provide input on the process.
